VISIUM Privacy Policy

Company: VISIUM AI LLC, a limited liability company organized under the laws of the State of Florida, United States, doing business as VISIUM ("VISIUM", "we" or "us").

Address: 1310 SW 74th Ct, Miami, Florida, United States.

Privacy contact: privacidad@visium-ai.com

Last updated: September 20, 2026 · Version: 2.1

Summary

VISIUM uses your information to create and manage your account, publish and optimize your Meta campaigns, run the AI Agent when you subscribe to it, bill you, and comply with the law. We do not sell your personal information. We call or text you for marketing purposes only with your consent, and you can stop it at any time. Our sites use the Meta Pixel for advertising and Google Analytics for measurement, described in section 7. This Policy is governed by the laws of the State of Florida and by the federal law of the United States. Write to privacidad@visium-ai.com to access, correct or delete your information.

1. Scope and governing law

This Policy applies to the VISIUM platform, including VISIUM Ads, the AI Agent for WhatsApp and the VISIUM websites, and to our customers, authorized users, prospects and visitors.

This Policy is governed by the laws of the State of Florida and by applicable federal law of the United States of America.

Transfer to the United States. VISIUM operates from the United States and stores and processes information in that country. If you access the platform from another country, your information is transferred to the United States, where data protection rules may differ from those of your country of residence. By using the platform, you acknowledge this transfer.

Rights that cannot be waived. If the law of the place where you reside grants you data protection rights that cannot be waived by contract, VISIUM will honor them to the extent that law applies to you.

Controlling language. This Policy was written in English. The Spanish version is a courtesy translation. If the two versions differ, the English version controls.

2. VISIUM's two roles

VISIUM as controller. This covers the information of the business that hires VISIUM, its authorized users, the prospects who request a demo and the visitors to our sites. VISIUM decides how that information is used and this Policy governs it. Requests about it go to privacidad@visium-ai.com.

VISIUM as processor. This covers the information of the people who respond to an ad and message the advertising business on WhatsApp. The advertising business decides how that information is used, and the Data Processing Agreement attached to the Terms and Conditions governs it. Requests about it go to that business rather than to us.

As a processor, VISIUM handles the information of those individuals only to provide the service to the advertising business, following its instructions and the Data Processing Agreement. We do not sell it, do not use it for our own purposes and do not combine it with information from other customers.

3. Information we collect

3.1 Information you give us

  • Identification and contact: name, company, job title, email address, phone number and WhatsApp number.
  • Account credentials: username and password. The password is stored only in encrypted form.
  • Billing: legal business name, tax identification number, billing address and payment history.
  • Content: messages, forms, and the images and videos you upload as creative for your ads.
  • Contact consent: the consent you give us to call or message you, including its date, the exact wording you accepted, the page where you gave it and the IP address it came from, and any request to stop.

3.2 Information generated when you use the service

  • Technical logs: IP address, device and browser type, access dates and times, and activity and error logs.
  • Platform usage: campaigns created, budgets, metrics and reports generated.
  • Browsing on our sites: the pages you view, the ad or link that brought you, and actions such as submitting a form or booking a call, collected through the cookies and pixels described in section 7.
  • Calls and messages with VISIUM: the date, time and content of the calls and messages between you and VISIUM, including recordings or transcripts when we have told you that a call is recorded.

3.3 Information we obtain from third parties with your authorization

  • Meta Platforms: when you connect your business portfolio we obtain identifiers for your page, ad account and WhatsApp Business, access tokens that we store encrypted, and campaign metrics, including a snapshot of the 30 days before the connection as a baseline.
  • Stripe: confirmation and status of your payments. We neither receive nor store full card numbers.

3.4 WhatsApp conversations of interested people

When a business subscribes to the AI Agent, VISIUM processes on that business's behalf the messages sent to it by people responding to its ads, including their content, profile name and WhatsApp number, along with the classification the AI Agent assigns to each conversation based on the criteria the business defined.

3.5 Information we do not ask for

VISIUM does not request sensitive information such as health data, biometric data, ethnic origin or beliefs. If a person volunteers it in a WhatsApp conversation, it is handled solely to provide the service to the advertising business.

4. How we use information

  • To create and manage your account and authenticate you.
  • To set up, publish and optimize your campaigns on Meta.
  • To run the AI Agent and email you about the people who meet your criteria, when you subscribe to that service.
  • To bill and collect payment through Stripe.
  • To give you support and send you operational messages about the service.
  • To prevent fraud and abuse, and to protect the security of the platform.
  • To improve the service using aggregated or pseudonymized data.
  • To measure and improve VISIUM's own advertising, and to show our ads to people who visited our sites or who resemble them.
  • To comply with legal obligations and respond to requests from authorities.
  • To contact you about VISIUM's services by email, phone call, text message or WhatsApp, as described in section 12, always with a way to opt out.

5. Artificial intelligence

VISIUM uses artificial intelligence models to generate recommendations, ad targeting and conversational replies. These are decision support tools: no decision with legal or similarly significant effects on a person is made solely by automated means. Campaigns created by the platform start in a paused state and require human activation.

The AI Agent reads and answers WhatsApp conversations on behalf of the advertising business. Each business is responsible for telling the people who message it that their conversations may be handled by an automated assistant.

VISIUM may also use artificial intelligence to contact you on its own behalf, for example with an assistant that answers your messages or with an AI-generated voice on a call, as described in section 12. When a call uses an AI-generated voice, we tell you at the start of the call.

Our customers' data is not used to train third party models.

6. Who we share information with

VISIUM does not sell personal information. On our own sites we use the Meta Pixel and Google Analytics, which receive information about your visit as described in section 7.

We share information only with providers acting under contract and on our instructions:

  • Meta Platforms: ad delivery and the WhatsApp Cloud API.
  • Stripe: payment processing.
  • Artificial intelligence providers: Anthropic and OpenRouter.
  • Infrastructure: application hosting, database, file storage and PDF report generation.
  • Sales operations: recording demo requests in our customer management system.
  • Meta Platforms, as an advertising tool, and Google, as an analytics tool: the Meta Pixel and Google Analytics 4 on our own sites, described in section 7.
  • Scheduling: Calendly, when you book a call with us.
  • Communications providers: delivery of our emails, calls and text messages, including AI voice and messaging tools.

You may request the current list of providers at privacidad@visium-ai.com.

About Meta and your ad account. VISIUM creates campaigns and reads metrics inside the ad account you connect. On your behalf, it does not send Meta conversion events, browsing data about visitors to your site or customer lists. The pixel described in section 7 measures visits to VISIUM's own sites, not to yours.

We may also disclose information to authorities where there is a legal obligation, to professional advisors under a duty of confidentiality and, in a merger, acquisition or sale of assets, to the acquirer, who will be bound by this Policy.

7. Cookies, pixels and similar technologies

Our sites and the platform use cookies and similar technologies, such as pixels and tags, that store or read small pieces of information in your browser.

  • Strictly necessary: to keep your session, protect the platform and remember your language preference.
  • Advertising: the Meta Pixel. We use it to measure how VISIUM's own advertising performs and to show our ads to people who visited our sites or who resemble them.
  • Analytics: Google Analytics 4, loaded through Google Tag Manager. We use it to understand how our sites are used, such as which pages are visited and where visitors come from. Google Tag Manager only loads that tool and does not collect information for purposes of its own.

What these tools receive. When you visit our sites, Meta and Google receive information about the visit through their own cookies and code: the pages you view, the date and time, your IP address, your browser and device, and cookie identifiers that they can link to your account with them if you have one. We also send Meta conversion events when you take certain actions, such as submitting a form or booking a call. Those events carry details like the campaign and the language of the page, and the answers you gave us about your business, such as your market and your number of active listings.

Events sent from our servers. We may send the same events from our servers through Meta's Conversions API. In that case, contact details such as your email address or phone number are hashed before they are sent, so that Meta can match them to an account without receiving them in readable form.

What we do not send. We do not use these tools to send your password, your payment information, or the conversations and personal information that we process on behalf of our customers.

Meta and Google use the information they receive under their own privacy policies, which in Meta's case may include improving its advertising products.

Your choices.

  • You can block or delete cookies in your browser settings. Strictly necessary cookies cannot be turned off without affecting how the platform works.
  • You can limit how Meta uses activity from other sites in your Meta ad preferences, and you can stop Google Analytics from measuring your visits with the Google Analytics opt-out add-on.
  • You can opt out of interest based advertising from participating companies at optout.aboutads.info.

We update this section when we add or remove one of these tools.

8. Retention

  • Account and contract data: for the length of the relationship and up to 5 years after it ends.
  • AI Agent conversations: up to 24 months, then deleted or anonymized.
  • Technical and security logs: up to 12 months.
  • Tokens for connected accounts: deleted when the integration is disconnected or the account is closed.
  • Data processed on a customer's behalf: for as long as that customer's instructions require. When the contract ends, returned or deleted within 30 days.
  • Ad creative: processed in order to publish it on Meta, and not stored permanently.
  • Advertising and analytics cookies: set by Meta and Google and kept for the period each of them defines. You can remove them at any time by deleting the cookies in your browser.
  • Contact consent and requests to stop: for as long as we may contact you and up to 5 years after the last contact, so we can show that we had your consent and that we honored your request.

9. Security

VISIUM takes reasonable measures to protect personal information, consistent with the Florida Information Protection Act of 2014, Fla. Stat. § 501.171. These include encryption in transit, encryption of credentials and tokens at rest, isolation of each customer's data, role based access control, secrets kept outside the source code, audit logs and least privilege.

When information is no longer needed, we delete it or render it unreadable in a secure manner. No system is infallible, but we work continuously to reduce the risks.

10. Security incident notification

If an incident compromises your personal information, VISIUM will:

  • Notify you without unreasonable delay and no later than 30 days after determining that it occurred, unless an authority asks us to hold off.
  • Notify the Florida Department of Legal Affairs when the incident affects 500 or more individuals in Florida.
  • Notify consumer reporting agencies when it affects more than 1,000 individuals at a single time.
  • Notify business customers within 72 hours of confirming an incident affecting data processed on their behalf.

11. Your choices

You may ask us at any time for:

  • Access: a copy of the personal information we hold about you.
  • Correction of inaccurate or incomplete information.
  • Deletion of your information, except what we must keep by law or to resolve disputes.
  • Portability: your data in a structured, commonly used format.
  • Opting out of marketing communications, without affecting operational messages about the service.

How to ask. Write to privacidad@visium-ai.com with your name, what you are asking for and a way to reach you. We will ask for what we need to verify your identity and will respond within 45 days. There is no charge.

If you messaged a business that uses VISIUM on WhatsApp, that business is responsible for your information and is where your request should go. If it reaches us, we will forward it without delay.

12. Marketing communications, calls and messaging

Email. Our marketing emails identify VISIUM as the sender, include our postal address and offer a simple way to unsubscribe, which we honor within 10 business days, as required by the federal CAN-SPAM Act.

Calls, text messages and WhatsApp from VISIUM. VISIUM may contact you by phone call, text message (SMS or MMS) or WhatsApp about its own services: for example, to follow up on a demo or a spot you requested, to help you get started, or to tell you about offers. These calls and messages may be placed or sent with automated technology, and may use a prerecorded voice, or an artificial or AI-generated voice or assistant.

Only with your consent. We make marketing calls and send marketing text messages with that technology only if you gave us your prior express written consent, for example by checking the box on one of our forms, and only to the number you gave us. Your consent is not a condition of purchasing anything from VISIUM. We keep a record of it, as described in section 3.

What to expect.

  • We identify VISIUM at the start of every call and message. When a call uses an AI-generated voice, we say so at the start of the call.
  • If a call is recorded or transcribed, we tell you at the start of the call.
  • We make marketing calls and send marketing text messages between 8 a.m. and 8 p.m. in your local time, and no more than three times in any 24 hour period about the same matter.
  • Message frequency varies. Message and data rates may apply.

How to stop. Reply STOP to any text message, tell us during any call, or write to privacidad@visium-ai.com. Reply HELP for help. You may withdraw your consent by any reasonable means. We honor your request promptly, and no later than 10 business days after we receive it, and we keep an internal do-not-contact list. Operational messages about an account you hold with us, such as security and billing notices, are not marketing and may continue.

We do not share your number for marketing. We do not sell or share phone numbers, or the consent you gave us to text you, with third parties or affiliates for their marketing purposes. The providers that deliver our calls and messages receive them only to do that on our behalf.

Messages sent by our customers. AI Agent conversations with the people who respond to a customer's ads begin when that person messages the business. If a business customer uses VISIUM to send outbound messages or to place calls, it is that customer's responsibility to hold the prior express written consent required by the Florida Telephone Solicitation Act and the federal Telephone Consumer Protection Act (TCPA), and to comply with the WhatsApp Business Messaging Policy.

13. Health information

VISIUM Ads is not designed to handle health information. When the advertising business works in a health field, such as a clinic or a medical practice, people may describe why they are seeking care in the conversation. VISIUM handles that information only on the business's behalf, does not use it for its own purposes and does not send it to advertising platforms.

VISIUM does not sign business associate agreements under the federal HIPAA law. For that reason, the platform must not be used to handle medical information protected by that law.

14. Minors

VISIUM is a service for businesses and professionals. It is not directed to people under 18 and we do not knowingly collect information from children under 13, consistent with the federal COPPA law. If we find a minor's information, we will delete it.

15. Changes to this Policy

We will publish any change on this site with its update date. If the change is material, we will notify you by email or inside the platform at least 10 days in advance.
